Q1. Term required for filing a patent application in poland?
The deadline for filing an application to grant a patent in Poland claiming priority is 12 months from the date of priority. The restoration of this term is not stipulated.
Q2. What is the Duration of Patents in Poland?
Patent protection has a term of 20 years beginning on the date of filing. NOTICE: A patent is granted subject to payment of a fee for the first protection period. Failure to pay the fee within the prescribed time limit results in declaring by the Patent Office that the decision on the grant of the patent has lapsed.
Q3. What are the Filing requirements in Poland?
For obtainment of the date of filing a Polish patent application should contain:
- request and parts which appear to be a description of the invention;
- patent claims, abstract, a title of the invention and figures if required.
Q4. How to examine a Poland patent application?
First phase of the examination:
- formal examination,
- search report,
- publication of the application.
NOTICE: During the examination of the patent application or within two months from the date on which a decision to refuse a patent becomes final, the applicant may request utility model protection. The utility model application shall be deemed to have been filed on the filing date of the original patent application
