Q1. Term required for filing a patent application in Sweden?
The term for filing a patent application in Sweden claiming priority is 12 months from the priority date. In case the application is not filed within the 12-month term, it is still possible to claim priority within 2 months after expiration of the initial term. An application for restoration must be filed alongside payment of the applicable fee.
Q2. What is the Duration of Patents of Sweden?
Patents in Sweden are valid for 20 years from the filing date. The first annual fee is payable for the third year from the filing date.
Q3. What are the Filing requirements in Sweden?
The languages of patent filing in Sweden are Swedish and English. If the application materials are filed in any other foreign language, the translation may be submitted within two months from entering the Swedish PCT national phase. If the application materials are submitted in English, the Swedish translation of claims is required at the time of grant.
For obtainment of the date of filing, a patent application based on PCT must contain:
- applicant's and inventor's details;
- international application in any language;
- payment of the official fee for filing.
