Term for filing the patent application in Switzerland claiming priority is 12 months from the priority date
Q2. What is the Duration of Patents in Switzerland ?
A Swiss patent guarantees protection in Switzerland and Liechtenstein, limited to 20 years, as long as the annual renewal fees are paid. If they aren't paid, the patent expires meaning that the invention belongs to the public domain.
Q3. What are the Filing requirements in Switzerland ?
the following should be submitted three months after the filing date at the latest:
- At least one patent claim defining the invention
- Technical drawings of reproducible quality
- An abstract
- A translation of the technical documents in one of the official Swiss languages (German, French or Italian) if the documents are not being submitted in one of the official languages or in English
- A declaration of any international priority rights being claimed as well as the priority document(s)
- The names and addresses of all inventors involved (in German, French and Italian)
- Any waivers by individual inventors to being named
- A translation of the technical documents in one of the official Swiss languages (German, French or Italian) if the documents have been submitted in English
Q4. How to examine a Switzerland patent application?
No request for conduction of a substantive examination is required. Before beginning of the substantive examination, the IPI sends an invoice for examination, where it indicates a time limit for payment of the prescribed fees.
