Q1. Term required for filing a patent application in Turkey?
The term for filing patent application in Turkey
The deadline for filing patent applications in Turkey claiming priority is 12 months from the date of priority. It is not possible to restore this term.
Q2. What is the Duration of Patents turkey?
Patent protection lasts 20 years from the date of filing of the application. The subject of the patent will become public property following expiry of the patent protection period (Article 140, Industrial Property Code). Turkish law does not allow for the renewal of a patent.
Q3. What are the Filing requirements in Turkey?
For obtainment of the date of filing a patent application in Turkey should contain:
- description of an invention in any official language of the country that is party to Paris Convention or WTO Agreement or in any official language of the country which grants legal and de facto protection to Turkish residents in accordance with reciprocity principle;
- request to grant a patent;
- name and address of applicant(s);
- payment of the official fee (must be submitted within seven days from filing).
Q4. How to examine a Turkishpatent application?
The applicant must request novelty search within 12 months from the date of filing. After receiving the search report, the applicant must request the substantive examination within 3 months.
