Q1. Term required for filing a patent application in Zambia?
The term of a patent is 16 years from the date of filing, which may be extended on the ground of inadequate remuneration for one further period of up to five years, and in exceptional circumstances for up to ten years.
Q2. What is the Duration of Patents of Zambia?
Patents Act provides that the duration of every patent granted shall be 20 years from the filing date of the application for the grant of a patent.
Q3. What are the Filing requirements in Zambia?
Filing Requirements:
- Published PCT application or English specification, claims, abstract and drawings (required on the day of filing)
- Power of Attorney, simply signed (required on the day of filing)
- Assignment of Invention (no set deadline)
- International Search Report and International Preliminary Report on Patentability (no set deadline)
- Certified priority document with verified English translation (can be filed within 6 months)
Q4. How to examine a Zambia patent application?
The application is examined as to form and substance alike. The term for requesting substantive examination is 3 years from the filing date.
